Content Creation Guidelines

You (‘Creator’ or ‘Creators’) engage, entertain, and inspire us (‘BattleBucks’ or the ‘Company’ or ‘we’ or ‘our’ or ‘us’) and our gaming community. To support your content creation related to the ‘Platform’ and/or the ‘Services’, we have established these Content Creation Guidelines (‘Guidelines’) to govern and guide the creation, distribution, and use of content associated with the Platform and/or the Services.

BattleBucks reserves the right to, from time to time, amend and modify these Guidelines. The User acknowledges and accepts that they may also be subject to receiving periodic communications from BattleBucks related to their obligation to comply with these Guidelines. It is the sole responsibility of the User to stay informed of any updates, or policy amendments or modifications issued by BattleBucks, as more particularly detailed in Section G (Amendments and modifications to the Terms or the BattleBucks Policies) of the Terms.

Non-compliance with the Guidelines invites penalties depending on the grade of the misconduct as set forth in Section D (Misconduct and Penalty Matrix) of the Rules of Conduct.

This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

A.Definitions

Any term not specifically defined herein shall have the meaning prescribed to it in the Terms and Conditions of the Company accessible at hear

  1. Creator Content means any material created, produced, recorded, or shared by the Creator that relates to, features, or incorporates the Platform, the Services, or any of the Company’s IP, including but not limited to fan art, videos, live streams, websites, posts, or other derivative or associated works.
  2. The Company’s IP (or Company’s Intellectual Property) means all content made available on the Platform, whether now or in the future, including but not limited to BattleBucks name, logo, tagline, game’s lore, characters, virtual items, in-game currencies, designs, images, music, videos, designs, and other creative elements, whether owned or controlled; registered or unregistered.

B.Creator Limited License

Any use of materials that can be identified as the Platform’s content constitutes the use of the Company’s Intellectual Property. By incorporating the Company’s IP, you agree that your use is subject to these Guidelines and the Terms, and is permitted solely under the limited licence granted by the Company hereunder.

The Company grants a non-exclusive, revocable, and limited license to Creators to create, share, and distribute content using the Company’s IP (‘Creator Limited License’). The Creator Limited License is granted solely for personal and non-commercial use unless explicitly permitted otherwise by the Company in writing.

Creators must ensure that any third-party intellectual property used in the Creator Content is duly licensed or that permission is obtained from the rightful owner. The Company disclaims all liability arising from any use of third-party IP by the Creator. Further, Creators shall comply with the community guidelines, terms and conditions, and policies of the platforms where the Creator Content is posted. Creators are strictly prohibited from:

  • Selling, sublicensing, or exploiting Creator Content using the Company’s IP without prior written approval.
  • Developing Creator Content that misrepresents itself as official content produced by the Company.
  • Using the Company’s IP in association with any offensive, defamatory, obscene, or inappropriate content.
  • Replicating or re-posting original content released by the Company without any modification or value addition.
  • Disclosing, sharing, or publishing any unreleased, confidential, or proprietary information related to the Platform or the Company.
  • Creating or uploading Creator Content that contains any derogatory, offensive, or defamatory remarks about race, ethnicity, gender, sexual orientation, religion, or any other group or promotes hate speech, violence, or inappropriate conduct.
  • Incorporating any unauthorised modifications, cheats, hacks, or any circumvention of the Platform’s intended gameplay.
  • Producing goods and merchandise for profit-seeking purposes using the Company’s IP.

The Creator retains ownership of the Creator Content but acknowledges and agrees that they are solely responsible for ensuring that the Creator Content complies with all applicable laws and adheres to these Guidelines at all times, and the Creator’s activity does not undermine the reputation of the Company or the Platform. The determination of whether any specific conduct impacts the reputation of the Company shall be made solely at the discretion of the Company. In the event of any breach of the above, the Company reserves the right, at its sole discretion, to revoke, suspend, or terminate the Creator Limited License without prior notice.

The Creator acknowledges and agrees that the Creator Content may be used, reproduced, displayed, published, transmitted, adapted, or otherwise exploited by the Company for the purpose of promoting, marketing, or publicising the Platform, the Services, and/or related campaigns or events. For these purposes, the Creator grants the Company a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable licence to use, reproduce, display, publish, broadcast, transmit, adapt, and otherwise exploit the Creator Content, including any accompanying name, username, or avatar, in any media now known or later developed, without any further consent, notice, or compensation. The Creator acknowledges that they shall not be entitled to any payment, royalty, or other consideration arising from the Company’s use of Creator Content.

C. Monetization

Creators are permitted to generate passive revenue through Creator Content, incorporating the Company’s IP under the following conditions:

  • Advertising revenue is generated through non-monetized videos on platforms, including but not limited to YouTube or Facebook.
  • Revenue from donations by fans or viewers.
  • Revenue is generated as part of a subscription service where access to the Creator Content is not limited to subscribers.

Notwithstanding anything contained above, the Creator is not permitted to use the Company’s IP for promoting or advertising games which are not associated with the Company, or selling or licensing content that includes the Company’s IP for consideration, whether in cash or in-kind.

D. Limitation of Liability

The Company’s liability with respect to any claims, losses, or damages arising out of or related to the Creator Content, including but not limited to intellectual property infringement, defamation, or violation of applicable laws, shall be governed by the Limitation of Liability provisions specified in Section N of the Terms.

E. Grievance Redressal Mechanism

If you believe you have been unfairly treated, harmed, or have encountered User behavior that violates the Guidelines, you have the right to raise a complaint or grievance in accordance with Section M (Grievance Redressal Mechanism) and Section P (Dispute Resolution and Arbitration Agreement) of the Terms.

F. Violation

Upon internal evaluation, if the Company concludes that any Creator Content, which incorporates or uses the Company’s IP, infringes or violates these Guidelines, the Company reserves the right to immediately remove such Creator Content without prior notice. Where the removal of such infringing or violating Creator Content is not directly within the Company’s technical control, the Company shall demand the Creator’s immediate removal of the Creator Content.

These Guidelines may be translated into other languages for the convenience of Users. However, in the event of any discrepancies between the English version and any translated version, the English version shall prevail.
